1. Right to withdraw from a distance contract

A consumer has the right to withdraw from a distance sales contract within 14 calendar days without giving a reason, subject to the exceptions established by law.

For goods, the period normally begins when the consumer, or a person nominated by the consumer other than the carrier, takes physical possession. If multiple goods from one order are delivered separately, it begins when the last item is received.

2. How to notify us

Before the 14-day period expires, email a clear statement of withdrawal to info@mccm.lt.

Include your name, order number, item being returned, date received and contact email. You may use the model statement at the end of this Policy, but it is not mandatory.

3. Sending the goods back

After notifying us, the consumer must return the goods without undue delay and no later than 14 days after giving notice.

Please package the goods securely for transport and retain proof of sending.

4. Direct return costs

When a conforming item is returned under the withdrawal right, the consumer bears the direct cost of returning it unless MCCM agrees to bear that cost or applicable law provides otherwise.

Where an item is damaged, defective or incorrectly supplied, MCCM bears reasonable return costs.

5. Inspection and diminished value

A consumer may inspect an item only as far as necessary to establish its nature, characteristics and functioning. The consumer is liable only for diminished value caused by handling beyond what was necessary for that inspection.

Opening ordinary delivery packaging or a normal retail box does not by itself remove the withdrawal right. The absence of original packaging may be taken into account only to the extent that it causes an actual reduction in the item’s value.

6. Health and hygiene exception

Under Article 6.228¹⁰(2)(5) of the Lithuanian Civil Code and Article 16(e) of Directive 2011/83/EU, the right of withdrawal does not apply to sealed goods that have been unsealed after delivery and are unsuitable for return for health-protection or hygiene reasons.

A consumer therefore cannot withdraw in respect of a cosmetic or hygiene product where:

the product was delivered with a genuine protective hygiene or tamper-evident seal;
that seal was opened or broken after delivery; and
the product is consequently unsuitable for resale for genuine health-protection or hygiene reasons.

This exception does not make all cosmetics automatically non-returnable. Ordinary shipping packaging, a delivery box or a normal retail carton is not, by itself, a hygiene seal.

The exception does not affect statutory remedies where an item is damaged, defective, unsafe or incorrectly supplied.

7. Damaged, defective or incorrectly supplied goods

Rights relating to damaged, defective or non-conforming goods are separate from the 14-day withdrawal right.

Contact info@mccm.lt and provide the order number, a description of the issue and photographs that help assess the item or shipment where reasonably available.

No separate 14-day reporting deadline applies to such claims. Applicable statutory conformity, guarantee and limitation periods continue to apply.

Depending on the circumstances and applicable law, the consumer may be entitled to replacement, repair, a proportionate price reduction, or termination and a refund. MCCM does not limit those mandatory rights.

8. Refunds

Following a valid withdrawal, we will reimburse payments received from the consumer, including the cost of our least expensive standard delivery method, without undue delay and no later than 14 days after receiving notice of withdrawal.

If the consumer selected a more expensive method than our least expensive standard delivery option, the additional cost is not refundable.

We may withhold reimbursement until we receive the goods or the consumer supplies evidence that they have sent them back, whichever occurs first.

The refund is made using the same payment method used for the original transaction unless the consumer expressly agrees otherwise. The consumer will not incur a fee as a result of the reimbursement.
